All bookings accepted by Tracks Vacations Ltd. are subject to the following terms and conditions.
1. Booking Terms No contract exists between the guest and Tracks Vacations Ltd. until the completed booking form and deposit have been received. The deposit of £100 per person is due at the time of booking, after which reservations will be confirmed. The guest making the booking and signing the booking form guarantees payment to us of the total cost of the holiday and does so on behalf of all members of that party.
2. Payment Payment in full, less any deposit received, must be made no later than 10 weeks prior to departure, unless agreed with management of Tracks Vacations Ltd. Tracks Vacations Ltd. have the right to apply cancellation charges as follows:-
More than 6 weeks before departure - loss of deposit
4-6 weeks before departure 50% of total cost
2-4 weeks before departure 75% of total cost
0-2 weeks before departure 100% of total cost
All requests for cancellation must be in writing. If the cancellation is received after the booking has been confirmed the above charges will apply. We advise all guests that on payment of the balance of their holiday they ensure that personal trip cancellation insurance is in effect.
3. Force Majeure and Liability
Tracks Vacations Ltd. undertake to provide the holiday as described in their literature/web site. However, in the event that circumstances beyond our control occur, Tracks Vacations Ltd. will not be responsible for; including, but not limited to, failure of mechanical and electrical equipment, act of God, war, civil disturbance, acts of Government, strikes or any other industrial action. Tracks Vacations Ltd. is not responsible for any misunderstandings between third parties. In the unlikely event that Tracks Vacations Ltd. have to cancel your holiday prior to the date of departure, the guest will be notified and a full refund made.
4. Travel Guests are responsible for making their own travel arrangements other than the contract made between Tracks Vacations Ltd and the guests regarding airport and/or rail station transfers. They must ensure that valid passports are held with any visas that may be required. Tracks Vacations Ltd cannot accept any responsibility for missed travel connections caused by adverse weather or traffic conditions.
5. Guest Responsibilities Guests are responsible for their own travel documents and medical and ski insurance. It is a condition of booking that guests have adequate winter sports insurance cover. Tracks Vacations Ltd. are not responsible for any consequential loss arising from any guest's accident or injury. All guests must undertake to behave in such a way as not to disrupt the enjoyment of others on holiday or in any way harm the reputation of Tracks Vacations Ltd. Tracks Vacations Ltd. have the right to terminate the contract with the guest if these conditions are breached. Any damage to the chalet, its contents or any equipment, will be charged to the guest and must be paid before their departure. No refund will be made to any whose holiday is curtailed in these circumstances.
6. Tracks Vacations' Ski/Snowboard/Resort hosts
Tracks Vacations Ltd cannot take responsibility of any guest injuries or damage to equipment and/or third parties however caused. Ski hosting is undertaken by the chalet staff on a purely voluntary basis, as and when time and their other duties permit. This facility is provided to assist guests to get maximum benefit from their ski pass by showing them; ski lifts, links, various pistes and bars/restaurants. Guests wishing to avail themselves of this service must be sufficiently competent skiers to cope with blue and red pistes, unaccompanied children are not permitted. Numbers and inclusion are at the discretion of the ski-host whose decision is final.
7. Complaints In the unlikely event that a guest should have cause for complaint during their stay, they should immediately inform the chalet hosts so that action can be undertaken. If the problem cannot be resolved at that time, they must write to Tracks Vacations Ltd. without undue delay, or in any event, no later than 28 days after the completion of their holiday.
8. Jurisdiction These conditions and any contract to which they apply are governed and constructed in accordance with English Law and are subject to the jurisdiction of the Courts of England and Wales.
